Terms & Conditions


1. Scope

1.1. The range of products for sale on the online shop “IIL Shop” (hereinafter the “online shop”) is exclusively for the students attending the Institut International de Lancy (IIL) and their parents/legal guardian(s) (hereinafter the “Customer”).
IIL automatically creates a customer account for each parent/legal guardian. The account is sustained for the duration of the student’s schooling at IIL and is automatically terminated when the student leaves the school. IIL reserves the right to block any customer account at its own and sole discretion and at any time.

1.2. The operator of the online shop and your contractual partner is the Association Institut de Lancy located at Avenue Eugène-Lance 24, 1212 Grand-Lancy (hereinafter the “Seller” or “IIL”).  

1.3. The General Terms and Conditions (hereinafter “T&Cs”) apply to all transactions concluded between the Customer and the Seller. IIL reserves the right to amend the present T&Cs at any time. As part of the ordering process, the Customer accepts the T&Cs in force at the time of ordering. Any specific conditions agreed orally, including by telephone, is not binding unless confirmed in writing. The requirement of written form is also fulfilled if the agreed elements are stated in an email.

2. Conclusion of the contract

2.1. All information regarding the offer, i.e. the range of goods and services (hereinafter the “goods”) for sale on the online shop and their prices, is non-binding for IIL. IIL reserves the right to modify the offer at any time. The images used including in catalogues of products, brochures, flyers and on the online shop, serve only as illustrations and are not binding for IIL.

2.2. The contract is concluded when the Customer clicks on the “Pay Now” button after completing the required information on the order page and entering the details for payment. The Customer can request a cancellation or a modification of the order within 24 hours maximum after order confirmation. Such a request must be made by email at shop@iil.ch. The contract is binding if IIL accepts the order in accordance with section 2.4.

2.3. After payment, the Customer receives an automated email in which IIL confirms that the order has been received (Confirmation of receipt). This confirmation only aims to inform the Customer that IIL has received the order.

2.4. IIL confirms the acceptance of the contract by issuing an invoice to the Customer which is sent by email (Confirmation of order preparation).

2.5. The contract is only concluded for the items expressly mentioned in the invoice/confirmation of order preparation. If the quantity ordered is not available, IIL immediately contacts the Customer, who will be given the possibility to be refunded or to maintain order if a restocking is planned.

2.6. The Customer can print the order summary and information entered during the ordering process. Invoices can also be printed/reprinted from the IIL Shop customer account. The order information can be viewed in the account of the Customer, by connecting with their personal login details. The data stored by IIL serves as proof of the conclusion of the contract and of the transaction.

3. Prices

3.1. All prices in the online shop are in Swiss francs (CHF) and include the legally prescribed VAT applicable at the time of ordering. IIL can change prices at any time without prior notice and at its sole discretion. The price is determined at the time of the order. IIL reserves the right to suspend an order where there is an obvious pricing error.  

3.2. There can be differences between the prices of goods at a reduced and/or discounted cost sold on the online shop and those of goods at a reduced and/or discounted cost sold in the shop on campus (hereinafter the “campus shop”). Such differences do not give rise to any price adjustment or subsequent credit.

3.3. The VAT exemption is not possible via on the online shop. If the Customer is entitled to such an exemption, they must go to the campus shop directly.

4. Payment

4.1. The purchase price can be paid by credit or debit card (VISA, Mastercard, Maestro, American Express, Apple pay). The data for payment by credit and debit card is transmitted in encrypted form.

4.2. Orders are payable immediately.

5. Collection of goods

5.1 As soon as the order is being prepared, the Customer receives a notification by email (Confirmation of order preparation). Orders can be collected directly from the campus shop located at Avenue Eugène-Lance 22, 1212 Grand-Lancy, during opening hours. The opening hours of the campus shop are published on the IIL’s website (www.iil.ch).

6. Obligation to examine goods and report defects, liability for defects

6.1. The Customer must check the goods collected as soon as possible in the normal course of business and must immediately report any defects by email at shop@iil.ch. If no defects are reported within the above-mentioned period, the goods are deemed approved. In any event, if the Customer has not made any complaint by email at shop@iil.ch within 2 days of collection of the goods, the approval is deemed to have been given.

6.2. If a defect, which was not recognisable during a proper examination compliant with section 6.1, is discovered, it must be immediately reported by email at shop@iil.ch Otherwise, the goods ordered are deemed approved.

6.3. Any defective goods can be exchanged at the campus shop during opening hours provided that a copy of the invoice and a detailed description of the defect are provided. IIL reserves the right to refuse any request for exchange which does not meet the above conditions. The goods exchanged become the property of the Seller.

7. Return policy

7.1. The Customer can return any goods directly to the campus shop within 14 calendar days after collection of the goods.  

7.2. Goods must be returned in their original packaging, in full, with original labels and all accessories, and a copy of the order form/invoice. Socks, protective masks, tights and other goods categorised as “Accessories” in the online shop and in the campus shop cannot be returned.  

7.3. The return policy does not cover normal wear and tear and/or consequences of mishandling, misuse or damage caused by the Customer or third parties.  

7.4. The goods must be returned to the campus shop located at Avenue Eugène-Lance 22, 1212 Grand-Lancy during the opening hours published on the IIL’s website (www.iil.ch) IIL reserves the right to refuse any request for return that does not meet the above conditions.

7.5. If an exchange of goods is not possible, IIL will refund the Customer the total price paid provided that the goods are returned in accordance with the above conditions and after verification of the goods. The refund amount is always credited to the payment method used for purchase.

8. Liability

8.1. To the extent permitted by law, IIL shall not be liable for any direct or indirect damage resulting from the use of the online shop, the ordering of goods or the conclusion of contracts via the online shop.
Any breach of contract and its legal consequences as well as any claim by the Customer, regardless of the legal basis, shall be finally settled in accordance with the present T&Cs. Any other claims by the Customer, regardless of the legal basis, are excluded, to the extent permitted by law. The Seller shall not be liable for damage not caused to the goods themselves.


9. Confidentiality

9.1. IIL gives great importance to the protection of the Customer’s personal data. The collection and processing of the Customer’s personal data by the Seller are explained in the Terms of Use and Privacy Policy published on the IIL’s website (www.iil.ch/en/terms-of-use) which form an integral part of the present T&Cs.

10. Divisibility Clause and subject to modification

10.1. Should one or more provisions of the present T&Cs be or become ineffective or should there be unforeseen gaps, the validity of the remaining provisions or the T&Cs as a whole shall not be affected. Invalid provisions or gaps shall be replaced by the applicable law.

10.2. Any changes or additions to the present T&Cs must be made in a form that allows for verification of the text, e.g. by email. This also applies to a change in the written form requirement. The use of the Seller’s services by the Customer after the amendment of the T&Cs implies that the Customer implicitly accepts the new T&Cs.

10.3. The Customer’s individual contractual terms, i.e. those which the Customer declares to be applicable by accepting the contract, do not form part of the contract. They are only valid if and in so far they have been expressly accepted in writing by the Seller.

11. Applicable Law / Jurisdiction

11.1.The present T&Cs have been written in French and English. In case of divergence between the two versions, the French version serves as reference and is legally binding.
The relationship between the Seller and the Customer is subject to Swiss law. Any dispute related to the relationship between the Seller and the Customer and/or to the present T&Cs shall be exclusively subject to the jurisdiction of the Geneva Tribunal, with the right to appeal to the Federal Tribunal.
